Access to special services and postal infrastructure elements

As the current holder of a postal license, Česká pošta, s.p. is obliged, in accordance with Section 34 of Act No. 29/2000 Coll., on Postal Services, as amended (hereinafter referred to as the "Postal Services Act"), to allow other operators, on the basis of a written contract, transparent and non-discriminatory access to elements of the postal infrastructure and to special services related to the operation of the postal infrastructure (hereinafter referred to as the "postal infrastructure"). The postal infrastructure includes a database of postal addresses with information on addressees who have requested the delivery of postal items to an address other than that specified by the sender and their new postal addresses, post office boxes, delivery boxes, use of forwarding services, return to sender services, and delivery services to postal addresses indicated on postal items.

Česká pošta, s.p. also allows everyone to use postal codes free of charge, which are numerical designations of Česká pošta, s.p. establishments, locations, or addressees introduced for the purpose of delivering postal items and remittances.

In accordance with Section 34(2) of the Postal Services Act, Česká pošta, s.p. publishes on its website information concerning access to postal infrastructure; the terms and conditions for concluding a contract and a draft contract containing the identification details of Česká pošta, s.p., the scope and specification of access to postal infrastructure, including the terms and conditions, technical parameters, and prices. Prices for access to postal infrastructure are negotiated on a cost-oriented basis.

Postal service operators within the meaning of the Postal Services Act have a legal right to access the postal infrastructure of Česká pošta, s.p.

If no agreement is reached within two months of the start of negotiations on the draft agreement, the Czech Telecommunications Office shall decide on the dispute concerning the adjustment of mutual rights and obligations on the basis of a proposal by either contracting party. The proposal of the contracting party for the resolution of the dispute must include a draft contract specifying the disputed parts. If the subject of the dispute is the price for access to the postal infrastructure, the Czech Telecommunications Office shall determine this price as part of its decision on the dispute.
